Again, Court Stops Police From Enforcing Tinted Glass Permit Nationwide

A Delta State High Court sitting in Orerokpe has granted an ex-parte order restraining the Inspector General of Police, the Nigeria Police Force and the Commissioner of Police in Delta State from restarting the enforcement of the tinted glass permit policy across the country.

The court also prohibited the police from stopping, intimidating, arresting, detaining or extorting motorists and other citizens under the guise of enforcing the policy.

In the same ruling, the court barred the IGP, the NPF and their officers, agents or representatives from using the Parkway Projects Account, described as a private contractor’s account, for the conduct of any government business, pending the hearing and determination of the substantive suit.

The injunction will remain in effect until the court hears and determines the main application.

Justice Joe Egwu issued the orders while ruling on an ex-parte motion filed by a Nigerian citizen, Mr Israel Joe, in suit number HOR/FHR/M.3/2025.

Mr Joe was represented by Mr Kunle Edun, SAN, alongside other legal practitioners.

The ruling effectively stops the Nigeria Police from implementing its earlier announcement to resume enforcement of the tinted glass permit policy on January 2, 2026.

In his decision, the judge stated: “An order of interim injunction restraining the 1st and 2nd respondents, their officers, men, agents, privies and/or contractors from implementing, enforcing or further implementing/enforcing the Tinted Glass Permit Policy scheduled to commence on January 2, 2026, pending the hearing and determination of the substantive application in this suit.

“An order of interim injunction restraining the 1st and 2nd respondents, their officers, men, agents, privies and/or contractors from stopping, harassing, arresting, detaining or extorting citizens/motorists under the guise of enforcing the Tinted Glass Permit Policy, pending the hearing and determination of the substantive application in this suit.

“An order of interim injunction restraining the 1st and 2nd respondents, their officers, men, agents, privies and/or contractors from continuing to use the Parkway Projects Account (a private contractor’s account) to conduct any government business, pending the hearing and determination of the substantive application in this suit.

“An order for substituted service on the 1st and 2nd respondents through the 3rd respondent at the Delta State Police Command Headquarters, Asaba, and for such service to be deemed good and proper service.”
